Please read these terms carefully before using GotNext.gg

IMPORTANT NOTICE: THIS AGREEMENT IS SUBJECT TO BINDING ARBITRATION AND A WAIVER OF CLASS ACTION RIGHTS AS DETAILED IN SECTION 14 BELOW.

These Terms of Service ("Terms") are entered into between you and GotNext LLC, a Delaware limited liability company ("GotNext," "we," "us," or "our"). These Terms govern your access to and use of the GotNext website located at gotnext.gg (the "Platform"), including any content, functionality, and services offered on or through the Platform.

GotNext is a tournament hosting platform that enables organizers to create and manage competitive gaming tournaments, and players to discover, register for, and participate in those tournaments. The Platform also provides Discord bot integration for tournament management, including slash commands, voice channels, and automated notifications.

By creating an account or using the Platform, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Platform.


1. Eligibility

You must be at least thirteen (13) years old to create an account and use the Platform. If you are between 13 and 18 years old, you must have the consent of a parent or legal guardian who agrees to be bound by these Terms on your behalf.

To host tournaments or make payments on the Platform, you must be at least eighteen (18) years old.

We reserve the right to request proof of age and to terminate accounts that do not meet eligibility requirements.


2. Account Registration

To access certain features of the Platform, including tournament participation and hosting, you must create an account. You agree to:

  • Provide accurate and complete information during registration
  • Maintain the security of your account credentials
  • Notify us immediately of any unauthorized access to your account
  • Accept responsibility for all activity that occurs under your account
  • Use only one account per person

You may optionally link external accounts to your profile, including gaming platforms (Xbox, PlayStation, Steam) and Discord. You are responsible for ensuring your linked accounts are in good standing and comply with their respective terms of service.


3. User Conduct

You agree not to:

  • Use the Platform for any unlawful purpose
  • Harass, abuse, or harm other users
  • Impersonate any person or entity
  • Cheat, exploit bugs, or use unauthorized software in any competition
  • Attempt to gain unauthorized access to the Platform or other users' accounts
  • Interfere with or disrupt the Platform or servers
  • Use the Platform to distribute spam, malware, or other harmful content
  • Create or use multiple accounts
  • Participate in any form of collusion, match-fixing, or win trading
  • Use any robot, spider, scraper, or automated means to access the Platform
  • Attempt to reverse engineer, disassemble, or decompile any part of the Platform

We reserve the right to suspend or terminate accounts that violate these Terms or engage in conduct we deem harmful to the community.


4. User Content

The Platform allows you to upload content, including profile pictures, team logos, tournament banners, sponsor logos, and other materials ("User Content"). You retain ownership of your User Content, but by uploading it to the Platform, you grant GotNext a worldwide, non-exclusive, royalty-free, transferable license to use, reproduce, modify, display, and distribute your User Content in connection with operating and promoting the Platform.

You represent that you own or have the necessary rights to your User Content and that it does not violate any third party's intellectual property or other rights.

We reserve the right to remove any User Content that violates these Terms or that we find objectionable at our sole discretion.


5. Tournament Hosting

Users may create and host tournaments on the Platform ("Host" or "Tournament Organizer"). By creating a tournament, you enter into an agreement with GotNext and agree to the following:

Host Responsibilities

  • Provide accurate and complete tournament information, including game title, format, rules, schedule, and prize details (if any)
  • Publish clear, complete tournament rules before registration opens
  • Ensure all tournament rules comply with applicable federal, state, and local laws
  • Moderate your tournament fairly and enforce rules consistently for all participants
  • Be available to respond to participant inquiries within twenty-four (24) hours during registration and within four (4) hours during active tournament play
  • Resolve disputes between participants within forty-eight (48) hours, or escalate to GotNext support
  • Not cancel a tournament after registration has opened except for circumstances beyond your control
  • Not use the hosting feature for fraudulent, deceptive, or illegal purposes
  • Indemnify and hold GotNext harmless from any claims arising from your tournament, including disputes with participants, prize fulfillment issues, or violations of applicable law

Tournament Rules Requirements

Before a tournament can be published, the Host must establish and publish tournament rules that include, at minimum:

  • Eligibility requirements
  • Game settings and match format
  • Check-in procedures and deadlines
  • Match reporting requirements
  • Dispute resolution procedures
  • Prize distribution details (if applicable), including timeline for distribution
  • Rules for disqualification

Prize Responsibility

Tournament Organizers are solely responsible for fulfilling any prizes they offer. GotNext does not hold, manage, or distribute prize money or physical prizes on behalf of Hosts. Organizers must honor all prizes as described in their tournament listing.

GotNext's Role

GotNext provides the platform infrastructure for tournament hosting but is not the organizer or sponsor of user-hosted tournaments unless explicitly stated. GotNext retains the right to:

  • Review and approve tournament rules before publication
  • Remove or modify tournaments that violate these Terms or applicable law
  • Intervene in disputes that Hosts fail to resolve within the required timeframe
  • Suspend or revoke hosting privileges for Hosts who violate these Terms or receive repeated valid complaints
  • Cancel tournaments that pose legal, reputational, or operational risk to the Platform

GotNext is not responsible for the conduct of Tournament Organizers or the outcome of user-hosted tournaments, but will make reasonable efforts to enforce these Terms and protect participants from fraudulent or abusive Hosts.

Legal Compliance

Tournament Organizers are solely responsible for ensuring their tournaments comply with all applicable laws, including prize promotion regulations, tax reporting obligations for prizes awarded, and any applicable consumer protection laws.


6. Tournament Participation

By entering a tournament, you agree to abide by the tournament-specific rules established by the Host in addition to these Terms. GotNext reserves the right to:

  • Disqualify participants for rule violations, cheating, or unsportsmanlike conduct
  • Modify, cancel, or postpone tournaments at any time
  • Make final decisions on all disputes

Disputes

When players disagree on a match result, a dispute may be created. Players are encouraged to record their matches, as video evidence is the primary factor in dispute resolution. Failure to provide evidence when requested may result in a ruling against you.

Tournament administrators and GotNext staff will review all available evidence and make a final determination. Administrator decisions are final and binding.

False Reporting

Deliberately false result reporting is a serious violation that may result in account suspension or permanent ban from the Platform.


7. Discord Bot Integration

GotNext offers a Discord bot ("GotNext Bot") that provides tournament management features within Discord servers. By using or interacting with the GotNext Bot, you agree to the following terms.

Bot Functionality

The GotNext Bot provides the following capabilities:

  • Slash Commands: Players can check in, view opponents, report match results, and view brackets directly from Discord
  • Voice Channels: Temporary voice channels are automatically created for tournament matches and deleted when matches complete
  • Direct Messages: The Bot may send DMs for account verification, match notifications, and achievement alerts
  • Role Management: The Bot may assign or remove Discord roles for verified users and tournament participants
  • Webhook Notifications: Tournament updates (registrations, match results, status changes) are posted to organizer-configured webhook channels

Account Linking

Linking your Discord account to GotNext is voluntary. You can link your account using the /verify command in Discord. You may unlink your Discord account at any time from your profile settings. Account linking enables enhanced features such as match-ready DMs and role assignment.

Bot Permissions

When a Tournament Organizer invites the GotNext Bot to their Discord server, the Bot requests the following permissions: Manage Channels (for voice channel creation), Manage Roles (for participant role assignment), and Send Messages (for notifications). The Bot only operates in servers where it has been explicitly invited by a server administrator.

Direct Messages

The GotNext Bot may send direct messages to users for account verification, match notifications, and achievement alerts. You can prevent these messages by disabling DMs from server members in your Discord privacy settings. The Bot will gracefully handle users who have DMs disabled.

Organizer Responsibility

Tournament Organizers who invite the GotNext Bot to their server are responsible for managing their Discord community. The Bot is a tool that assists with tournament management; the Organizer remains responsible for their server's rules, moderation, and compliance with Discord's Terms of Service.

Availability

The GotNext Bot is provided on a best-effort basis. We do not guarantee that the Bot will be available at all times. Bot downtime, errors, or feature changes will not be grounds for refunds of tournament hosting fees.


8. Payments and Fees

Tournament Hosting Fees

Tournament Hosts may be charged a platform fee for using GotNext's tournament hosting features. Current fees are displayed during tournament creation and are subject to change with notice. By creating a tournament, you agree to pay all applicable platform fees.

Payment Processing

Payments are processed by Stripe. By making payments through the Platform, you agree to be bound by Stripe's terms of service and privacy policy. GotNext does not store your complete payment card information — this data is securely handled by Stripe.

Currency

All fees are denominated and processed in United States Dollars (USD).

Chargebacks

If you believe a charge is incorrect, please contact us at brock@gotnext.gg before initiating a chargeback with your bank. Initiating a chargeback may result in account suspension pending resolution.


9. Refund Policy

Tournament hosting fees are generally non-refundable once a tournament has been created. Refunds may be considered on a case-by-case basis for significant technical issues caused by the Platform that prevented a tournament from occurring.

To request a refund, contact us at brock@gotnext.gg within fourteen (14) days of the transaction. Include your account email, transaction details, and reason for the refund request. Refund requests are reviewed within 5-7 business days.


10. Intellectual Property

Platform Ownership

The Platform and its original content, features, and functionality are owned by GotNext and are protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the Platform without our prior written consent.

Limited License

You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Platform for personal, non-commercial purposes (or commercial purposes in the case of tournament hosting), subject to these Terms.

Third-Party Intellectual Property

GotNext features tournaments and competitions for games owned by third parties. All game titles, logos, and related imagery are the property of their respective owners. GotNext is not affiliated with, endorsed by, or sponsored by any game publisher unless explicitly stated.

DMCA Compliance

GotNext respects the intellectual property of others. If you believe your work has been copied in a way that constitutes copyright infringement, please send a notification to brock@gotnext.gg containing:

  1. A physical or electronic signature of the copyright owner or authorized agent
  2. Description of the copyrighted work claimed to be infringed
  3. Description of where the infringing material is located on the Platform
  4. Your contact information (address, phone number, email)
  5. A statement that you have a good faith belief the use is not authorized
  6. A statement under penalty of perjury that the information is accurate

Counter-Notice: If you believe content was removed in error, you may submit a counter-notice containing: your signature, identification of the removed content, a statement of good faith belief, your contact information, and consent to jurisdiction in the federal judicial district where your address is located.


11. Disclaimers

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT GUARANTEE THAT THE PLATFORM WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

TO THE FULLEST EXTENT PERMITTED BY LAW, GOTNEXT DISCLAIMS ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

We are not responsible for any losses resulting from:

  • Unauthorized access to your account
  • Technical issues, bugs, or server downtime
  • Actions of other users or Tournament Organizers
  • Third-party services or linked accounts
  • Payment processing errors by third-party processors
  • Discord Bot unavailability or errors
  • Prize fulfillment by Tournament Organizers (GotNext does not manage or guarantee prizes)

12. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, GOTNEXT SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE PLATFORM, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM YOUR USE OF THE PLATFORM SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO GOTNEXT IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED DOLLARS ($100).


13. Communications

By creating an account, you consent to receive communications from GotNext, including service announcements, administrative messages, and promotional materials. You may opt out of promotional communications at any time through your account settings.

Communications made using the Platform should not be considered private. You acknowledge that you have no expectation of privacy concerning communications through the Platform. Avoid sharing personally identifiable information in public communications.


14. Binding Arbitration and Class Action Waiver

READ THIS SECTION CAREFULLY. IT MAY SIGNIFICANTLY AFFECT YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT.

These provisions apply to you if you are domiciled in and/or use the Platform in the United States or Canada.

Initial Dispute Resolution

GotNext's support team is available to address any concerns you may have. Most concerns are quickly resolved through informal communication. The parties shall use their best efforts to settle any dispute through consultation and good faith negotiations, which shall be a precondition to either party initiating a lawsuit or arbitration.

Binding Arbitration

If the parties do not reach an agreed-upon solution within thirty (30) days from the time informal dispute resolution is pursued, then either party may initiate binding arbitration as the sole means to formally resolve claims.

All claims arising out of or relating to these Terms, the parties' relationship, and/or your use of the Platform shall be finally settled by binding arbitration administered by the American Arbitration Association in accordance with its Consumer Arbitration Rules.

Location

For residents of the United States, arbitration will take place at any reasonable location convenient for you. For residents outside the United States, arbitration shall be initiated in Delaware, and you agree to submit to the personal jurisdiction of courts in Delaware to compel arbitration or confirm awards.

Class Action Waiver

THE PARTIES AGREE THAT ANY ARBITRATION SHALL BE CONDUCTED IN THEIR INDIVIDUAL CAPACITIES ONLY AND NOT AS A CLASS ACTION OR OTHER REPRESENTATIVE ACTION. The parties expressly waive their right to file a class action or seek relief on a class basis.

YOU AND GOTNEXT AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.

Exception: Small Claims and IP Claims

Either party may bring an action in small claims court for disputes within that court's jurisdiction. Either party may also seek relief in state or federal court for patent, copyright, trademark, or trade secret claims.

Changes to This Section

GotNext will provide sixty (60) days' notice of any changes to this Section. Changes will become effective on the 60th day and will apply prospectively only.


15. General Provisions

Indemnification

You agree to indemnify and hold harmless GotNext and its owners, operators, employees, and affiliates from any claims, damages, losses, or expenses (including reasonable legal fees) arising out of your use of the Platform, your User Content, your hosting of tournaments, your violation of these Terms, or your violation of any law or the rights of any third party.

Termination

We may suspend or terminate your account at any time, with or without cause, and with or without notice. You may delete your account at any time through your account settings or by contacting us at brock@gotnext.gg. Termination does not affect any rights or obligations that accrued prior to termination. Sections 4, 10, 11, 12, 14, and 15 survive termination.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. Any claims not subject to arbitration shall be resolved in the state or federal courts located in Delaware.

Third-Party Services

The Platform may contain links to third-party websites or services, including payment processors, gaming platforms, and Discord. We are not responsible for the content, terms, or practices of any third-party services.

Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will notify you by posting the updated Terms on the Platform and updating the "Last Updated" date. Your continued use of the Platform after changes are posted constitutes your acceptance of the revised Terms. For material changes affecting payments or the arbitration provisions, we will provide at least sixty (60) days' notice.

Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

Entire Agreement

These Terms, together with our Privacy Policy and any tournament-specific rules, constitute the entire agreement between you and GotNext regarding your use of the Platform and supersede any prior agreements.
